AUSTIN, Texas: The U.S. District Court of Western Texas has granted CrowdStrike (NASDAQ: CRWD) a motion to dismiss a consumer class action suit brought by airline passengers who claimed they experienced flight disruptions as a result of a software outage in July 2024.

The ruling states that the claims related to airline services are preempted by the federal Airline Deregulation Act (ADA). To prevent a patchwork of inconsistent state laws governing the airline industry, the US Congress included a preemption provision in the ADA, which expressly preempts state-law claims related to airline services.

“That the plaintiffs here bring their suit against CrowdStrike, rather than against the airlines themselves, does not prevent ADA preemption,” the US District Court order stated.

“We are grateful for the Court’s thoughtful consideration and decision to dismiss this case,” said Cathleen Anderson, chief legal officer at CrowdStrike.
